Legislator-Zusammenfassung

The Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of appeal, thereby upholding the lower court's decision and leaving the plaintiff to bear the costs of the proceedings. The dispute concerned a consumer credit agreement where the plaintiff challenged the lower court's refusal to allow a revision appeal regarding the validity of a withdrawal right under the Consumer Credit Directive. The decisive legal basis is Article 14(1) of Directive 2008/48/EC, as interpreted by the Court of Justice of the European Union and German case law, which establishes that no withdrawal right exists once a loan agreement has been fully performed before the declaration of withdrawal; the court determined that the case lacked fundamental significance and did not require the revision court's decision for the development of law or uniform application of the law.
