The German Federal Court of Justice (BGH) dismissed the defendant's complaint against the refusal to admit a revision appeal, leaving the decision of the 17th Civil Senate of the Oberlandesgericht Köln in force and ordering the defendant to bear the costs of the complaint proceedings. The dispute concerned a civil litigation over the exercise of a unilateral option right by the plaintiff, where the defendant challenged the lower court's interpretation that such an action did not constitute "new" state aid under Article 1(c) of Regulation (EU) No 2015/1589, thereby precluding a referral to the Court of Justice of the European Union under Article 267(3) TFEU. The BGH held that the case raised no questions of fundamental significance and that the appeal failed to meet the requirements for revision under § 543(2) ZPO for the development of law or uniform jurisprudence, as the lower court's treaty interpretation did not itself present a ground for admission.

[GRUENDE]
