Admission of revision for non-admission of EU guideline conformity and good faith questions in insurance litigation
Legislator-Zusammenfassung
KI-generiertThe plaintiff's complaint for non-admission of revision was dismissed, and the judgment of the Oberlandesgericht Karlsruhe dated January 26, 2022, stands final. The dispute concerned a civil matter where the plaintiff challenged the appellate court’s refusal to allow a revision on the grounds of lack of fundamental legal significance, need for legal development, or securing uniform jurisprudence, while also raising constitutional arguments under Articles 3(1) and 103(1) of the Basic Law. The Federal Court of Justice found no fundamental significance or need for legal development under § 543 Abs. 2 Satz 1 ZPO, rejected the constitutional grievances as unfounded, and determined that the issue of conformity with EU guidelines or a preliminary reference to the Court of Justice of the European Union regarding good faith principles was not decisive for the outcome, thereby denying the revision and imposing costs on the plaintiff under § 97 Abs. 1 ZPO.
