Admissibility of revision for insurance withdrawal objection based on good faith and EU conformity of policy model
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the appellate court's judgment and leaving the lower-instance outcome in force. The dispute concerned insurance law, specifically challenging the insurer's objection to a policyholder's notice of withdrawal on grounds of good faith and asking whether the policy model was EU-compliant. The Court determined that neither fundamental legal significance nor the need to develop the law justified a revision hearing, as the appellate court had correctly applied the principle that substantial circumstances are required for a withdrawal to be deemed treacherous when proper instruction was not provided, and that the question of EU conformity was not decisive to the outcome. The decisive legal basis involved § 543 Abs. 2 ZPO (grounds for revision), § 5a Abs. 1 Satz 1 VVG (good faith objection in insurance), and § 544 Abs. 6 ZPO (exemption from detailed reasoning for specific procedural matters).

BVerfGK 19, 467, 475; 18, 105, 111 f.; 6, 79, 81 ff.).
Die Klägerin trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
