Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the complaint and rejected the applicant's request for the assignment of a court-appointed counsel, finding the intended legal enforcement hopeless. The applicant had filed a complaint, characterized as a legal complaint (Rechtsbeschwerde), against a decision by the Landgericht Trier made within the context of interim injunction proceedings (einstweilige Verfügung). The court held that such a legal complaint is not statutorily admissible in proceedings for interim injunctions under § 78b ZPO, rendering the application to appoint a lawyer at the BGH unfounded due to the futility of the appeal. Consequently, the prior lower court decision remains effective as the remedy was procedurally unavailable.

BGH, Beschluss vom 11. Januar 2023 - I ZB 120/22, juris Rn. 3 mwN).
