The German Federal Court of Justice (BGH) dismissed the plaintiff's non-admission complaint, upholding the lower court's decision that the legal issue did not require a revision ruling, thereby leaving the defendant's position intact. The dispute concerned a consumer credit agreement where the borrower attempted to exercise a right of withdrawal after the loan had already been fully repaid. The court determined that under the interpretation of Article 14(1) of Directive 2008/48/EC, confirmed by the Court of Justice of the European Union and prior BGH case law, no right of withdrawal exists once a loan contract has been fully performed. Consequently, the plaintiff bore the costs of the proceedings, and the matter was closed with no substantive change to the lower instance rulings.
