Adequacy of evidentiary motion under § 244(3) sentence 1 StPO: requirement to name a specific piece of evidence for cash register records
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant's appeal as unfounded, affirming the judgment of the Berlin Regional Court and ordering the defendant to bear the costs of the legal remedy. The dispute centered on whether the trial court properly rejected a defense motion for an "inspection of records" concerning specific cash register entries at a grocery store involved in the underlying criminal case; the defendant argued that this refusal violated the right to a fair hearing and led to a failure to exonerate. The Court held that the motion was correctly treated as an impermissible request for evidence gathering rather than a valid evidentiary motion under § 244(3) sentence 1 of the Code of Criminal Procedure, as it lacked the necessary specificity by failing to identify a concrete piece of evidence, and thus did not constitute a valid procedural objection.
