Tort claim against engine manufacturer for vehicle emissions fraud: failure to substantiate participation in vehicle manufacturer’s intentional statutory violation under § 823(2) BGB and EG-FGV
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, upholding the appellate court's dismissal of the tort claim and leaving the defendant without liability. The dispute concerned a claim for damages under § 823(2) BGB in conjunction with the German Emissions Gasoline Vehicle Ordinance, where the plaintiff attempted to hold the defendant, an engine manufacturer, liable for alleged emissions fraud. The court rejected the appeal because the plaintiff failed to demonstrate the materiality of the legal grounds for admission, specifically noting that the defendant was not a vehicle manufacturer and that the plaintiff did not sufficiently substantiate a claim that the engine manufacturer had participated in a deliberate violation of law by the vehicle manufacturer.
