Evidentiary value of passive arrest demeanor in criminal conviction proof
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's appeal, upholding the Landgericht Detmold’s conviction and ordering the defendant to bear the costs of the proceedings and necessary expenses for the victim and civil claimant. The dispute concerned the sufficiency of evidence for the defendant’s perpetrator status in a criminal trial, specifically challenging the lower court’s reasoning that relied in part on the defendant’s passive and calm demeanor upon arrest as an indication of guilt. The court held that under § 349(2) of the Code of Criminal Procedure, the appeal failed because the contested reasoning regarding the arrest demeanor was legally dubious and lacked clear inductive value; however, this flaw did not affect the final judgment because the court concluded that the conviction rested on numerous other independent indications, thereby excluding any error of law to the defendant’s detriment.
