Tort liability of engine manufacturer for vehicle emission violations: participation in intentional statutory breach by vehicle manufacturer under § 823 Abs. 2 BGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice rejected the plaintiff's complaint against the non-admission of leave to appeal, thereby upholding the appellate court's judgment and leaving the defendant's position intact. The dispute concerned a claim for damages arising from alleged violations of engine emission standards, where the plaintiff had attempted to base the liability on tortious conduct under German civil law. The court denied the admission of the revision because the plaintiff failed to adequately demonstrate that the defendant, acting solely as an engine manufacturer and not a vehicle manufacturer, had participated in an intentional statutory violation by the vehicle manufacturer. Consequently, the specific statutory combination referenced in the complaint was found inapplicable to the defendant's role, and the complaint was dismissed without further substantive reasoning.
