Drug trafficking sentencing: Validity of mitigating weight assigned to marihuana's lower danger potential compared to amphetamines
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Justice (3rd Senate) dismissed the defendant's appeal as unfounded, affirming the judgment of the Bochum Regional Court dated June 19, 2023, and ordering the defendant to bear the costs of the legal remedy. The dispute concerned the sentencing in a drug trafficking case involving marihuana, where the lower court had treated the substance as a non-hard drug with lower addiction and danger potential as a mitigating factor. The Senate confirmed that this assessment did not violate the principles of sentencing, explicitly noting that the comparative lower danger of marihuana was not unduly undervalued to the defendant's detriment when weighed against the moderate danger of amphetamines cited elsewhere in the judgment. The decision relies on § 349 Abs. 2 StPO for the standard of review and establishes that the general context of the judgment demonstrates a compliant balancing of drug-specific danger factors in the criminal sentencing process.

BGH, Beschluss vom 14. März 2023 – 4 StR 475/22 Rn. 9; Urteil vom 12. März 2020 – 4 StR 537/19 Rn. 11 mwN).
