Denial of admission of revision in consumer contract dispute under EU Regulation 715/2007
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (6a Civil Senate) dismissed the plaintiff's appeal against the non-admission of revision, ordering that the lower court's judgment from the Oberlandesgericht Frankfurt in Kassel remains in force and awarding costs to the defendant. The dispute concerned a civil matter subject to EU Regulation (EC) No 715/2007, where the appellant sought to overturn a procedural decision denying leave for a third-instance review. The court held that the appeal failed because the appellant did not sufficiently demonstrate that the legal questions raised, which allegedly had fundamental significance under § 543(2)(1)(1) ZPO, were decisive in light of the specific prerequisites of Art. 3 No. 10 of Regulation (EC) No 715/2007; consequently, there was no need for the Supreme Court to intervene for the development of law or uniform jurisprudence under § 543(2)(1) ZPO.
