Non-admission of revision in insurance contract dispute; EU directive compatibility and preliminary ruling on good faith defense not required
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (4th Civil Senate) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the lower court's decision and leaving the outcome of the prior instance in force. The dispute concerned an insurance contract claim, specifically the application of the model policy clauses and the defense of *venire contra factum proprium* (good faith), where the plaintiff sought a preliminary reference to the Court of Justice of the European Union. The court held that the compatibility of the model policy with EU directives was not decisive for the outcome and that a preliminary ruling was not required regarding the *venire contra factum proprium* defense, citing established case law; the court further verified that the revision would have lacked a prospect of success. The plaintiff was ordered to bear the costs of the complaint proceedings, and the dispute value was set at €25,185.67.
