Applicability of collegial court guidelines to detailed interim injunctions in public liability cases involving property auction disputes
Legislator-Zusammenfassung
KI-generiertThe BGH 3rd Civil Senate rejected the plaintiff’s complaint for non-admission of revision, upholding the lower court's decision and ordering the plaintiff to bear the costs. The dispute concerned a claim for damages against public authorities arising from the enforcement of an auction involving twelve horses, where the plaintiff challenged the failure to consider her ownership rights. The court held that the legal question regarding the applicability of the collegial court guidelines to interim legal protection decisions with detailed substantive review was moot, as the lack of fault on the part of the officials was established independently of that doctrine, rendering the appeal without merit under § 543 Abs. 2 ZPO.
