Legislator-Zusammenfassung

The Federal Court of Justice (3rd Criminal Division) denied the prosecution's request for the physical presence of the convicted defendant at the revision hearing, determining that personal appearance was not required. The defendant had been sentenced to a total custodial term of three years and six months for intentional drunkenness and embezzlement, with a subsequent order for commitment to a detoxification institution; the prosecution filed a revision against this judgment based on a substantive legal argument (Sachrüge). The court held that the revision hearing is strictly limited to the legal review of the challenged judgment pursuant to § 337 German Code of Criminal Procedure (StPO) and that the risk of the court rendering its own decision on the merits under § 354 StPO was negligible based on the file. Consequently, the court found that no special personal circumstances, nor the requirements of equality of arms or the right to an effective defense, mandated the defendant's attendance, as his defense counsel would be present in court.

September 2023 - 5 StR 215/23, juris Rn. 2; vom 13. Dezember 2022 - 1 StR 284/22, juris Rn. 4; vom 28. Mai 2020 - 3 StR 77/20, juris Rn. 3).
