Sexual abuse of a child in a two-person relationship: Impossibility of fulfilling the actus reus of § 176 Abs. 1 Nr. 1 Alt. 2 StGB through passive tolerance by a guarantor
Legislator-Zusammenfassung
KI-generiertThe BGH 4th Criminal Senate dismissed the auxiliary victim’s appeal as unfounded, upholding the Landgericht Münster’s judgment of 16 May 2022 and ordering the appellant to bear the costs of the appellate proceeding and the defendant’s necessary expenses. The dispute concerned the defendant’s conviction for sexual abuse of a child under § 176 Abs. 1 Nr. 1 Alt. 2 StGB, specifically challenging the lower court’s failure to explicitly address whether the defendant held a guarantor status under § 13 Abs. 1 StGB. The court held that this omission was legally correct because the specific statutory provision requires active interference with the child; in a two-person scenario involving the offender and the victim, a guarantor’s passive tolerance of sexual acts performed by the child on the offender cannot fulfill the actus reus of this provision, rendering a separate analysis of guarantor liability unnecessary for the final outcome.
