The Third Criminal Senate of the Federal Court of Justice granted the defendant's application for reinstatement into the former state regarding the expired deadline for filing a reasoned appeal and subsequently dismissed the appeal against the district court's judgment as unfounded, leaving the lower court's conviction in force and ordering the defendant to bear the costs of the legal remedy and the victims' necessary expenses. The dispute concerned a criminal judgment where the appellate court's original reference to surveillance video recordings as a stand-alone evidentiary basis was acknowledged as procedurally flawed, but the court found no error adverse to the defendant because the judgment had otherwise sufficiently described the camera content and the defendant had admitted the objective course of events. The decision relied on §§ 44, 46 StPO for the procedural reinstatement, § 349 Abs. 2 StPO for the dismissal of the appeal, and § 267 Abs. 1 Satz 1 StPO regarding the requirements for proper reference to evidence in a judgment.
