The Federal Court of Justice rejected the defendant's complaint against the non-admission of revision, upholding the Landgericht Stuttgart's judgment and ordering the defendants to bear the costs of the proceedings. The dispute concerned a civil matter within the jurisdiction of the 5th Civil Senate, where the defendants challenged the lower court's refusal to allow appeal to the BGH. The Court determined that the case raised no questions of fundamental legal significance and that an appeal was unnecessary for the development of law or ensuring uniform jurisprudence under § 543(2) ZPO, thereby denying access to the highest court. Additionally, the decision included a subsequent correction under § 319(1) ZPO to rectify an obvious error in the party designation in the caption, specifying the exact property owners involved rather than the broader group listed in a previous document.

Senat, Beschluss vom 12. März 2020 - V ZR 160/19, WM 2020, 1796 Rn. 5).
