Dismissal of complaint against non-admission of revision without reasoning under § 544 Abs. 6 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-allowance of a revision by the Higher Regional Court of Cologne, leaving the lower court's procedural ruling in force; the defendant is ordered to bear the costs of the complaint proceedings, with an amount in controversy of €69,732.99. This decision addresses a procedural challenge to the denial of appellate review in a civil matter, where the complainant argued that a revision should have been permitted. The court refused to provide a substantive justification for the dismissal, citing § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, which allows omitting reasons when they would not contribute to clarifying the conditions for granting a revision, and applied § 97 Abs. 1 ZPO to assign litigation costs to the losing party.
