Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (6th Civil Senate) dismissed the plaintiff and cross-respondent's complaint against the admission of revision, rejecting the appeal and upholding the lower court's order, with the plaintiff bearing the procedural costs and the cross-complaint's Streitwert set at 35,000 euros. The dispute concerned a civil matter where the appellant argued that the case possessed fundamental significance or required legal development to ensure uniform jurisprudence, but the court found neither ground applicable. The decision rests on §§ 543(2) Sentence 1 and 544(6) Sentence 2 Half-sentence 2 of the German Code of Civil Procedure (ZPO), which allow for the rejection of a non-admission complaint without a detailed written justification when the statutory prerequisites for a revision hearing are not met, alongside cost allocation rules under §§ 97(1) and 101(1) ZPO.
