The German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the appellate decision and leaving it in force, with the plaintiff bearing the costs of the complaint proceedings. The dispute concerned a civil liability matter with a subject matter value of approximately €1.8 million, where the plaintiff sought to challenge the appellate court's refusal to allow the case to proceed to the BGH for review. The court applied § 544 Abs. 6 Satz 2 ZPO, dispensing with a written justification because the grounds for the dismissal were not deemed suitable to contribute to the clarification of the requirements for admitting revision to the Supreme Court.
