The German Federal Court of Justice (BGH) rejected the plaintiff’s complaint against the non-admission of her appeal to the revision instance, thereby upholding the judgment of the Cologne Higher Regional Court (16th Civil Senate) from June 23, 2021, which stands as the final operative outcome. The dispute, valued at approximately €3.38 million, arose from a civil litigation matter in which the plaintiff sought to challenge the lower court’s decision but failed to demonstrate the necessary grounds for an appeal; the plaintiff and her auxiliary parties bore the costs of the proceedings. The court dismissed the complaint without a detailed written reasoning, applying § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, on the basis that such an explanation would not contribute to clarifying the prerequisites for admitting a revision appeal.
