Non-admission of revision: omission of reasoning in civil complaint against BGH rejection
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) rejected the defendant's complaint against the non-admission of revision, thereby upholding the appellate court's decision and leaving the lower court judgment in force; the defendant bears the costs of the complaint proceedings, with a disputed value of €31,610.59. The case involved a civil dispute in the 7th Civil Senate where the appellant challenged the Regional Court of Düsseldorf's decision not to allow a further appeal to the BGH. The court ordered no reasoned decision on the merits of the complaint, explicitly stating that such an explanation would not contribute to clarifying the conditions for admitting revision, in accordance with Section 544(6) Sentence 2, Second Half-Sentence of the Code of Civil Procedure (ZPO), which permits omitting the written rationale when a decision is clear.
