Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice dismissed the defendant's complaint against the non-admission of revision, thereby upholding the lower appellate court's refusal to allow the defendant to appeal the decision to the federal level; the defendant bears the costs of the complaint proceedings, and the underlying appellate judgment remains in force. The dispute arose from a civil liability matter with a disputed value of approximately 53,672.29 euros, where the defendant sought to challenge a prior judgment. The Court ordered no written reasoning, invoking § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, on the grounds that providing an explanation would not contribute to clarifying the prerequisites for admitting a revision to the federal level.
