The Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of a revision appeal to the higher court, thereby affirming the lower court's decision and leaving it in force. This decision concluded a civil dispute wherein the plaintiff challenged the appellate court's refusal to grant review of the final judgment, a move the BGH rejected without providing a substantive written reasoning as it was deemed unnecessary for clarifying the prerequisites for admission. The court's order rests on the procedural ground that a motivation for the dismissal would not contribute to legal clarification under Section 544(6) Sentence 2, Second Half-Sentence of the Code of Civil Procedure (ZPO), while the plaintiff was ordered to bear the costs of the complaint proceedings pursuant to Section 97(1) ZPO, with a dispute value set at 62,479.91 euros.
