Dismissal of non-admission complaint without reasoning under § 544 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the lower court’s refusal to grant leave for revision, thereby upholding the final judgment of the Higher Regional Court of Munich dated June 15, 2021, and ordering the plaintiff to bear the costs of the proceedings; the dispute concerned a civil matter with a subject matter value of €96,907.50, where the plaintiff challenged the appellate court’s decision not to allow a further appeal to the Federal Court of Justice. The court applied § 544 Abs. 6 Satz 2 ZPO (German Code of Civil Procedure) to waive the provision of a detailed legal reasoning, determining that such an explanation would not contribute to clarifying the prerequisites for admitting revision, and applied § 97 Abs. 1 ZPO for the cost allocation against the unsuccessful complainant.
