Denial of reasoning for non-admission of revision in specific performance dispute for real estate transfer
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision, leaving the judgment of the Dresden Higher Regional Court in force and ordering the defendant to bear the costs of the appellate proceedings. The dispute involved a claim for specific performance of a real estate transaction, specifically the transfer of ownership of an apartment, where the appellate court had ordered the defendant to effect the transfer and advance litigation costs. The BGH refused to explain the denial of leave to appeal, deeming a reasoning unnecessary for clarifying the prerequisites for revision under Section 544 Paragraph 6 Sentence 2 Second Half-Sentence of the Code of Civil Procedure (ZPO), and set the amount in dispute at approximately 920,565 euros, comprising the purchase price of the property and the advanced costs.
