Non-admission of revision in civil proceedings under § 544 Abs. 6 ZPO without reasoned judgment
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) Seventh Civil Senate dismissed the plaintiff's complaint against the non-admission of revision, leaving the lower court's judgment in force and ordering the plaintiff to bear the procedural costs. The dispute concerned a civil matter where the plaintiff challenged the Brandenburg Higher Regional Court's refusal to allow an appeal to the BGH, with a subject matter value of €97,535.40. Under § 544(6) sentence 2, second half-sentence ZPO, the court declined to provide a written reasoning, determining that such an explanation would not contribute to clarifying the prerequisites for admitting a revision.
