BGH declines to write reasons for dismissing revision non-admission complaint where reasoning would not clarify admissibility prerequisites
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, leaving the lower court’s judgment in force and ordering the plaintiff to bear the costs of the appellate proceedings. The case involved a civil dispute with a subject matter value of €51,800, where the plaintiff challenged the appellate court’s decision to refuse permission for a further appeal to the supreme court. Relying on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, the BGH declined to provide a detailed written justification, determining that such an explanation would not contribute to clarifying the prerequisites for admitting a revision, thereby upholding the procedural bar against further appeal.
