Omission of revision allowance reasoning under § 544 Abs. 6 Satz 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-allowance of an appeal to the supreme court, thereby upholding the decision of the Hamburg Higher Regional Court and leaving the lower instance judgment in force; the defendant bears the costs of the proceedings, while intervening parties bear their own. The dispute arose from a civil action where the defendant sought to challenge the appellate court's refusal to admit a revision appeal. The decision is based on the application of Section 544(6) sentence 2, second half, and Section 101(1) of the Code of Civil Procedure (ZPO), which permitted the court to dispense with a substantive written reasoning as it would not contribute to the clarification of the conditions for allowing an appeal.
