Waiver of revision justification and cost allocation for non-admission of appeal under §§ 544, 97, 101 ZPO
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of appeal, leaving the Kammergericht judgment in favor of the plaintiff in force; the defendant bears the costs of the proceedings, including those caused by the plaintiff's co-intervener, with a disputed value of €282,758.08. The case involved a dispute where the defendant sought to challenge the lower court's refusal to allow a revision appeal. The BGH declined to provide a written reasoning for the dismissal, citing that such an explanation would not contribute to clarifying the prerequisites for admitting a revision under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, while applying §§ 97 Abs. 1 and 101 Abs. 1 ZPO for cost allocation.
