Admissibility of revision for non-admission of appeal; dispensing with reasoning under § 544(6) ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiffs' complaint against the non-admission of revision, resulting in the lower appellate court's decision on dismissal of the appeal standing in force. The dispute concerned a civil matter involving a claim in the amount of €28,277.29, where the plaintiffs challenged the Oberlandesgericht's refusal to allow an appeal to the supreme court. The Court applied § 544 (6) sentence 2, second half-sentence of the Code of Civil Procedure (ZPO), declining to provide a reasoned decision on the grounds that such a rationale would not contribute to the clarification of the prerequisites for admitting a revision, and ordered the plaintiffs to bear the costs of the proceedings pursuant to § 97 (1) ZPO.
