Non-admission of revision in civil proceedings and justification for omitting reasoned decision
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiffs' complaint against the non-admission of revision, thereby upholding the appellate court's decision and leaving the lower court judgment in force; the plaintiffs bore the costs of the proceedings, with the amount in controversy set at 78,710.40 EUR. The dispute concerned a civil matter where the plaintiffs sought to challenge the appellate court's refusal to grant leave for a further appeal, raising procedural admissibility issues. The court declined to provide a substantive written reasoning, relying on § 544(6) sentence 2, second half-sentence of the German Code of Civil Procedure (ZPO), which allows omitting the explanation if it would not contribute to clarifying the conditions under which revision is to be admitted.
