Denial of leave to appeal: Waiver of reasoning under § 544(6) sentence 2, second half-sentence ZPO where clarification of admissibility prerequisites is not contributed
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the defendant's complaint against the denial of leave to appeal to the supreme court, leaving the Oberlandesgericht Bamberg's prior decision in force; consequently, the defendant bears the costs of the complaint proceedings and the object value is set at €65,942.52. This decision arises from a civil dispute where the defendant challenged the procedural denial of revision, an issue the BGH resolved without providing a substantive written rationale under § 544(6) sentence 2, second half-sentence ZPO, deeming an explanation unnecessary for clarifying the prerequisites for admissible revisions. The operative legal basis for the procedural dismissal and cost allocation is found in §§ 544 and 97(1) ZPO.
