Legislator-Zusammenfassung

The Federal Court of Justice dismissed the plaintiff’s non-admission complaint against the Higher Regional Court of Koblenz’s refusal to allow appeal, leaving the lower court’s judgment in force; the plaintiff’s auxiliary party bears the costs of the complaint proceedings. The dispute arose from a civil action where the plaintiff sought to overturn the appeal court’s decision, which had rejected the merits of the case. The court declined to provide a substantive written reasoning, determining that such an explanation would not contribute to clarifying the prerequisites for admitting an appeal under § 544 Abs. 6 Satz 2 ZPO. The operative legal basis is the procedural statute governing non-admission complaints in the German Code of Civil Procedure, specifically the discretionary exclusion of reasons when no significant legal issue or error in the lower court’s reasoning is established.
