Non-admission of revision: Omission of reasoning under § 544 Abs. 6 Satz 2 ZPO where justification would not clarify admissibility prerequisites
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant’s complaint against the non-admission of a revision appeal, thereby upholding the prior decision of the Higher Regional Court of Bamberg and leaving the underlying lower court judgment in force, with the defendant bearing the costs of the complaint proceedings and the matter valued at €125,000. The dispute arose from a civil proceeding in which the defendant sought to challenge the exclusion of its revision appeal, but the court found no grounds to overturn the lower instance's refusal. The decision relied on § 544(6) Sentence 2, Second Half-Sentence of the Code of Civil Procedure, which permits the omission of a reasoned judgment when a reasoning would not contribute to clarifying the prerequisites for admitting a revision, and § 97(1) of the Code of Civil Procedure regarding cost allocation.
