Omission of reasoning for dismissal of non-appealability complaint
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiffs' non-appealability complaint, thereby upholding the appellate court's refusal to admit revision and leaving the lower court's judgment in force; the plaintiffs, as the losing party in the appellate proceedings, were ordered to bear the costs of the complaint procedure as joint debtors. The case involved a dispute where the plaintiffs sought to challenge the 2nd Civil Senate of the Koblenz Higher Regional Court's decision via the BGH, with the dispute amount capped at 290,000 EUR. The court's decision relied on § 544 Abs. 6 Satz 2, 2nd half-sentence ZPO, which permits omitting the substantive reasoning if such a justification would not contribute to clarifying the conditions under which revision should be admitted, and § 97 Abs. 1 and § 100 Abs. 4 Satz 1 ZPO for the allocation of procedural costs.
