The Federal Court of Justice (I Civil Senate) dismissed the defendant's complaint against the non-admission of revision, thereby upholding the judgment of the Frankfurt Higher Regional Court from April 3, 2025; the defendant bore the costs of the complaint proceedings and the costs incurred by the plaintiff's auxiliary party, with the amount in dispute set at €481,412.82. The case involved a civil dispute where the defendant challenged the lower court's refusal to allow an appeal to the supreme court, arguing issues of fundamental significance, violations of procedural fundamental rights, or the need to develop the law or ensure uniform jurisprudence. The court rejected these arguments, finding that the case lacked fundamental significance, the procedural rügen were ineffective, and the legal questions did not necessitate a decision by the revision court under § 543 para. 2 sentence 1 ZPO, and it dispensed with a detailed written reasoning pursuant to § 544 para. 6 sentence 2 half-sentence 2 ZPO.
