Legislator-Zusammenfassung

The German Federal Court of Justice (BGH) dismissed the plaintiff's complaint, upholding the higher regional court's refusal to allow an appeal to the supreme court, thereby leaving the judgment of the Higher Regional Court of Rostock in force and assigning the plaintiff the costs of the complaint proceedings. The dispute concerned a civil matter with a subject value of €188,353.50, where the plaintiff sought to challenge the appellate decision through a revision appeal. The court declined to provide a reasoned decision, invoking § 544 Abs. 6 Satz 2, second half-sentence of the Code of Civil Procedure (ZPO), on the grounds that such an explanation would not contribute to the clarification of the prerequisites for admitting a revision, and relied on § 97 Abs. 1 ZPO for the cost allocation.
