The Federal Court of Justice (BGH) dismissed the plaintiff’s complaint against the non-admission of revision, thereby upholding the lower court’s final decision and leaving the Kammergericht’s judgment of January 18, 2022, in force. This procedural ruling concerns a civil dispute involving an amount in controversy of €179,357.68, where the plaintiff sought to have the case admitted for further review by the BGH. The court applied § 544(6) sentence 2, second half-sentence, of the German Code of Civil Procedure (ZPO), determining that a written statement of reasons was unnecessary because it would not contribute to clarifying the prerequisites for admitting a revision. Consequently, the plaintiff was ordered to bear the costs of the complaint proceedings, including those caused by third-party interventions on the defendant’s side, while the plaintiff’s auxiliary litigant bears its own costs under § 97(1) and § 101(1) ZPO.
