The German Federal Court of Justice (BGH) dismissed the defendant's complaint for non-acceptance of revision, thereby upholding the appellate court's judgment and leaving the lower court decision in force. The dispute concerned a civil matter with a value in dispute of €40,000, in which the defendant attempted to challenge the Oberlandesgericht München's refusal to accept the case for federal review. The BGH denied the application without providing a substantive reasoning, as it determined that such an explanation would not contribute to clarifying the prerequisites for admitting revision, pursuant to § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO. Consequently, the defendant was ordered to bear the costs of the proceedings under § 97 Abs. 1 ZPO, with no grounds stated to facilitate future filtering by specific legal issues.
