Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice (BGH) dismissed the defendant's complaint against the lower court's refusal to permit revision, leaving the judgment of the Rostock Higher Regional Court of 8 September 2023 in force, with the defendant bearing the costs of the proceedings and a subject-matter value of €136,382.94. The dispute concerned a civil claim where the defendant challenged the appellate court's decision not to admit a further appeal to the BGH, arguing that the prerequisites for revision were met. The BGH declined to provide a detailed written reasoning, relying on the statutory provision that such a rationale would not contribute to clarifying the conditions for admitting a revision. The decision was based on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO (German Code of Civil Procedure) for the waiver of reasons, and § 97 Abs. 1, § 101 Abs. 1 ZPO for the cost allocation.
