Non-admission of revision: BGH refuses reasoned decision under § 544(6) No. 2 ZPO where clarification of admissibility prerequisites is not served
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the second defendant's complaint against the non-admission of revision filed by the Munich Court of Appeals, leaving the appellate decision in force and ordering the defendant to bear the costs of the complaint proceedings. The case involved a civil dispute where the defendant sought to challenge the Oberlandesgericht München's March 23, 2022, order refusing to admit a further appeal to the Supreme Court. The BGH declined to provide a substantive written reasoning pursuant to § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, as a justification was deemed unlikely to contribute to the clarification of the prerequisites for admitting a revision. The decision establishes the final procedural status of the matter, with a matter value capped at €155,000.
