Dismissal of non-admission of revision in civil liability dispute
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the appeals of both the plaintiff and the defendant against the non-admission of revision to the Federal Court by the Higher Regional Court of Düsseldorf, thereby leaving the lower court's judgment in force; the plaintiff was ordered to bear 77% of the procedural costs, including the majority of costs caused by a supporting intervenor, while the defendant bore 23%, with the intervening party retaining the remainder. The dispute concerned a civil liability matter with a value in dispute of €187,643.38, where both parties challenged the procedural refusal to allow an appeal to the Federal Court. The court relied on § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO to dismiss the appeals without reasoning, as such reasoning would not contribute to clarifying the prerequisites for admitting revision, and applied §§ 92 Abs. 1 Satz 1, 101 Abs. 1 ZPO for the cost allocation.
