Objection to refusal of leave for appeal in civil litigation regarding cost allocation under § 544(6)(2) ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant’s complaint against the non-admission of appeal (Revision), thereby rejecting the defendant’s challenge and upholding the final judgment of the Cologne Higher Regional Court. The dispute involved a civil matter concerning a significant financial claim valued at approximately €1.23 million, where the defendant sought to overturn the lower court’s decision. In applying § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, the court deemed a written reasoning unnecessary as it would not contribute to clarifying the conditions for admitting an appeal, and ordered the defendant to bear the costs of the proceedings pursuant to § 97 Abs. 1 ZPO.
