The Federal Court of Justice (BGH) 7th Civil Senate dismissed the plaintiff's complaint against the non-admission of revision, thereby leaving the judgment of the Naumburg Higher Regional Court in force and imposing the costs of the proceedings on the plaintiff. The dispute concerned a civil matter valued at €100,000, where the plaintiff sought to challenge the lower court's refusal to admit an appeal to the BGH based on alleged defects in the appellate judgment. The court denied the request for a reasoned decision under § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, determining that such a reasoning would not contribute to clarifying the prerequisites for admitting a revision, and consequently ruled that the plaintiff bore the costs of the complaint and the ancillary intervention costs caused by the defendant's support.
