Objection to non-admission of revision: dismissal without reasoned justification under § 544(6) sentence 2, second half-sentence ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's non-acceptance complaint against the Oberlandesgericht Stuttgart's refusal to admit revision, thereby upholding the lower court's decision and ordering the defendant to bear the costs of the complaint proceedings. The dispute, with a value in dispute of €93,868.76, involved a civil matter where the defendant challenged the 10th Civil Senate's decision not to allow an appeal to the supreme court. The BGH decided without providing a detailed written justification, applying the provision that such an explanation is omitted when it would not contribute to clarifying the prerequisites for admitting a revision under § 544(6) sentence 2, second half-sentence of the Code of Civil Procedure (ZPO).
