Non-admission of revision in civil procedure: Omission of grounds justification under § 544 Abs. 6 ZPO
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the Oberlandesgericht Düsseldorf's judgment and leaving the lower court's decision final; in this procedural matter concerning a civil dispute, the plaintiff sought to challenge the non-admission of an appeal to the higher courts, but the BGH found the complaint unmeritorious. The decisive legal basis was Section 544(6) Sentence 2, second half of the Code of Civil Procedure (ZPO), under which the court was not required to provide a substantive written justification for the dismissal because such an explanation would not contribute to clarifying the conditions for admitting a revision.
