The Federal Court of Justice (7th Civil Senate) dismissed the defendant's complaint against the non-admission of a revision appeal, thereby upholding the lower appellate court's judgment and leaving the original decision in force, with the defendant ordered to bear the costs of the appellate proceedings. The case involved a civil dispute where the defendant challenged the Oberlandesgericht Braunschweig's refusal to allow the case to proceed to the supreme court for further review. The court denied the request without providing a substantive justification, relying on the procedural doctrine that an explanation would not contribute to clarifying the conditions under which a revision appeal must be admitted, as governed by § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO, and assessing the subject matter value at €51,418.69 under § 97 Abs. 1 ZPO.
