The Federal Court of Justice (BGH) 7th Civil Senate rejected the defendant's complaint against the non-admission of revision, thereby upholding the lower court's decision and leaving the original judgment in force. The dispute concerned a civil matter where the defendant sought to challenge the appellate court's refusal to allow the case to proceed to the highest instance, with the subject value set at €43,234.26. The court applied § 544 Abs. 6 Satz 2, 2. Halbsatz ZPO to dispense with a substantive written reasoning, determined that a detailed explanation would not contribute to clarifying the preconditions for admitting revision, and ordered the defendant to bear the costs of the complaint proceedings under § 97 Abs. 1 ZPO.
